§ 1 Subject Matter
This agreement covers the temporary rental of the holiday home Ocean Balaia, Quinta da Balaia 54, 8200-594 Albufeira, Portugal for holiday purposes. The property is equipped as described on the website. Maximum occupancy is 10 persons.
§ 2 Contract Formation and Booking
A binding rental agreement is concluded upon completion of the online booking and payment of the deposit. The landlord confirms the booking by email. The guest receives a booking confirmation containing all essential contract details.
§ 3 Rental Price and Payment Terms
The rental price is based on the current pricing displayed on the website.
- A deposit of 50 % of the total rental price is due upon booking.
- The remaining balance of 50 % must be paid no later than 60 days before the agreed arrival date.
- If the remaining balance is not paid on time, the guest will be reminded by email. If payment remains outstanding, the booking will be cancelled, the period released, and the deposit retained.
Payment is made by credit card via the payment service provider Stripe.
§ 4 Security Deposit
In addition to the rental price, a security deposit of EUR 2,000.00 is required. The deposit will be authorised or charged by credit card. It serves as security for any damage to the rental property. The deposit will be released in full after departure and inspection of the property, at the latest within 14 days of departure.
§ 5 Arrival and Departure
- Check-in: from 16:00
- Check-out: by 10:00
Different times are only possible with prior written agreement with the landlord.
§ 6 Cancellation Policy
Cancellation is possible at any time by email to info@oceanbalaia.com. The following conditions apply:
- The deposit is non-refundable in all cases.
- Upon cancellation, the booked period will be released.
- In the event of no-show or early departure, no refund of payments already made will be given.
Guests are advised to take out travel cancellation insurance.
§ 7 Exclusion of Right of Withdrawal
Pursuant to Art. 6(1)(k) of Directive 2011/83/EU, the statutory right of withdrawal does not apply to contracts for accommodation services for a specific date or period. No right of withdrawal therefore exists for this booking.
§ 8 Occupancy and Use
Maximum occupancy is 10 persons. Exceeding this limit is not permitted and entitles the landlord to immediate termination of the contract without refund. The property is to be used exclusively for holiday purposes. Commercial use, events, parties or subletting are prohibited without the express written consent of the landlord.
§ 9 House Rules
- Smoking is not permitted inside the holiday home.
- Pets are only permitted with prior arrangement.
- The guest must treat the property and its furnishings with care.
- Any damage must be reported to the landlord immediately.
- Upon departure, rubbish must be disposed of and the inventory left in proper order.
§ 10 Landlord’s Liability
The landlord is liable for damage suffered by the guest resulting from intentional or grossly negligent breach of duty by the landlord. Any further liability is excluded to the extent permitted by law. The landlord accepts no liability for force majeure, natural events or disruptions caused by third parties.
§ 11 Guest’s Liability
The guest is liable for all damage to the property, furnishings and inventory caused by them, their fellow travellers or visitors. Damage must be reported immediately. The guest is fully liable for damage caused through their fault.
§ 12 Applicable Law and Jurisdiction
The law of the Republic of Portugal applies. For consumers within the European Union, the mandatory consumer protection provisions of the guest’s home country remain unaffected. The place of jurisdiction for merchants and persons without a general place of jurisdiction in Portugal is Albufeira, Portugal.

§ 13 Severability Clause
Should individual provisions of these Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions.
